CBA Tech Talk – “Disputes Management Procedure and Standing Conciliators: The Public Works Contracts : Clause 13: Some Observations” at 16:30 on 26th June 2019, Gaffney Room in Law Library Distillery

The CBA are pleased to announce that Tom Wren, Managing Director of  Tom Wren Associates, will present his paper, “Disputes Management Procedure and Standing Conciliators: The Public Works Contracts : Clause 13: Some Observations”, on Wednesday 26th June at 4.30pm in the Gaffney Room, Distillery Building.  In addition, David O’Leary, Managing Director, MKM Dispute Resolution, has kindly offered to provide a counterpoint on this topic.

Tom Wren has been in private practice for fifteen years and possesses 35 years of national and international construction experience in the fields of quantity surveying, construction claims management and disputes resolution.  He is a panellist on the Construction Industry Federation’s and the Law Society of Ireland’s panels of construction disputes resolvers, a member of the Chartered Institute of Arbitrators Irish Branch Committee and a Registered Quantity Surveyor in Ireland. His practice undertakes a range of public and private work for local authorities, architects, solicitors, developers, consultants, main contractors, sub contractors and liquidators.  Briefs include roads and bridges, housing, schools, hotels, commercial, high rise, treatment plants, mechanical & electrical, piling & foundations, pharmaceutical facilities, power plants, ports and military installations.  He has held briefs as arbitrator and an advocate in mini-trials, mediations, conciliations and arbitrations and holds current conciliation briefs. He is the author of “Public Works in Ireland: Procurement and Contracting”.  Tom has vast experience in the construction industry in Ireland and abroad, including UK, USA, Malaysia, Bahrain, Qatar, India, Hong Kong, Kuwait and Cyprus.

David O’Leary David has practiced as a Chartered Quantity Surveyor for over thirty years including as Managing Director of OLM Consultancy up to 2011. In recognition of the costs associated with Arbitration and the industry requirement to resolve disputes in an efficient and cost effective manner; David initiated, and was the founding Managing Director of, MKM Dispute Resolution in 1992. MKM promoted Mediation and Conciliation as a means of resolving building, engineering and related disputes until their formal incorporation in dispute clauses in the standard main contracts and associated sub contracts.  In addition to practising as a Mediator / Conciliator since the early 1990’s David has also given many talks on the subject. David obtained a Barrister-at-Law degree from the Honorable Society of Kings Inns in 1991. This legal qualification, combined with David’s dual experience as a practicing Chartered Quantity Surveyor and Mediator / Conciliator has been recognised in the industry and has resulted in many appointments as Arbitrator by agreement of the disputing parties.  David has practised as a Mediator / Conciliator in construction and engineering disputes since 1994 and as an Arbitrator since 2001, and appointments have also been received as Adjudicator and Expert Determinator.  David has also prepared many Expert Reports and appeared as an Expert Witness in Arbitrations and Court Hearings.
