Please note that David Dodd BL will deliver his paper on the law and practice in relation to Article 16 of the Model Law on Wednesday, 29th June 2016 at 8:30 am in the Sheds Distillery Building (registration from 8:15).
Members will be aware that Article 16 of the Model Law recognises the competence of an arbitral tribunal to rule on its own jurisdiction. Article 16(2) provides that where a party challenges the jurisdiction of the arbitrator, it must do so before the submission of the statement of defence. The arbitrator can rule on any allegation or challenge raised and resort to the High Court may only be sough to resolve the issue on jurisdiction where it has first been dealt with as a preliminary question by the arbitral tribunal.
